Terms and Conditions

Version 2026.07.16-LEGAL_REVIEW. These Terms describe ShareMiles as a no-cost, peer-to-peer, non-commercial ride cost-sharing marketplace. They do not claim regulatory exemption, automatic insurance coverage, or that ShareMiles can never be liable.

How ShareMiles works

  • ShareMiles connects members already planning compatible journeys so they can travel together and share eligible ride costs.
  • ShareMiles provides technology to connect Hosts and Guests on the Platform (website, mobile web and Android app).
  • ShareMiles does not own, operate, control or provide vehicles.
  • ShareMiles is not a taxi, cab, chauffeur or professional transportation provider.
  • Hosts are independent members and are not employees, agents, contractors or representatives of ShareMiles.
  • ShareMiles does not direct Hosts’ working hours, routes, schedules or availability.
  • Hosts must already be planning the ride independently of any Guest request.
  • ShareMiles does not guarantee that a ride will occur, arrive on time, be safe, be suitable or be completed.
  • ShareMiles currently charges no platform, booking or service fee.
  • ShareMiles may introduce a separately disclosed flat platform fee in the future only after updating these Terms, providing advance notice and obtaining any legally required renewed consent. Introducing a future fee does not convert a Ride Contribution into Host income or a commercial fare.

Definitions

  • “ShareMiles” means the technology marketplace that enables members to discover and coordinate compatible, independently planned rides.
  • “Host” means a member who is already planning and undertaking a ride, offers available seats, and drives or is legally responsible for the vehicle.
  • “Guest” means a member requesting or occupying an available seat in a Host’s independently planned ride.
  • “Ride Contribution” means a Guest’s contribution toward eligible ride costs. It is not a commercial fare, wage, income, reward or payment for professional transportation.
  • “Ride” means an independently planned, non-commercial journey shared by members.
  • “Platform” means the ShareMiles website, mobile-web experience and Android application.

Cost sharing, not commercial transport

  • Ride contributions are intended only to share eligible journey costs such as fuel, tolls and reasonable vehicle expenses. Hosts must not make a profit.
  • Eligible ride costs may include fuel, tolls, parking directly related to the ride, and reasonable vehicle operating expenses where legally permissible. These Terms do not imply that every possible vehicle expense can be passed to Guests.
  • By publishing a ride, Hosts agree that: they are already planning the published ride; they are not publishing principally to earn income; they are using ShareMiles privately and non-commercially; they will bear their own fair share of ride costs; total Guest contributions will not exceed eligible ride costs; they will not make a profit; they will not request additional, hidden or undisclosed payments; they will not use ShareMiles as a taxi, cab, commercial transport service, employment opportunity or recurring income source; and they will provide accurate route, time, vehicle, contribution and identity information.
  • ShareMiles may review ride frequency, contribution amounts and other activity for suspected commercial use, and may restrict, suspend or terminate an account where commercial activity, unsafe conduct or policy violations are suspected.

What Hosts agree to

  • Every Host confirms that they hold a valid driving licence for the vehicle; they are legally authorized to use the vehicle; the vehicle has valid registration, insurance and PUC documentation; the vehicle is safe, roadworthy and properly maintained; their insurance permits carrying Guests under the proposed cost-sharing arrangement; they have independently confirmed adequate insurance rather than relying on ShareMiles; they will obey traffic, safety and motor-vehicle laws; they will not drive under the influence of alcohol, drugs or impairing medication; they will not use a phone unlawfully while driving; they will not exceed lawful seating capacity; they will use seat belts and require Guests to use them where available; they are responsible for selecting the route, operating the vehicle and conducting the ride; they will promptly disclose cancellations, material delays or changes; they will not misrepresent their identity, vehicle or ride; they will not allow an unapproved substitute Host to conduct the ride; and they will protect Guest information and use it only to coordinate the ride.

What Guests agree to

  • Every Guest confirms that they understand the Host is a private member, not a ShareMiles employee or professional driver; they independently decide whether to travel with a Host; they will review the Host, vehicle, ride and available verification information; they will arrive at the agreed pickup point on time; they will pay only the disclosed Ride Contribution; they will not request unlawful driving, unsafe stops, overcrowding or material route changes; they will behave respectfully and lawfully; they will use available seat belts; they will not carry illegal, dangerous or undisclosed prohibited items; they will provide accurate identity and booking information; they will follow reasonable vehicle-safety rules established by the Host; they will report safety concerns, misconduct and incidents promptly; they understand that verification reduces risk but does not guarantee another member’s identity, conduct or safety; and they remain responsible for determining whether the arrangement is suitable for them.

Insurance and road-travel risk

  • Road travel carries inherent risks including collision, injury or death, delay, cancellation, vehicle breakdown, misconduct by another member, and loss or damage to personal property.
  • Members voluntarily decide whether to participate after reviewing available information.
  • ShareMiles does not provide vehicle or ride insurance unless a specific policy is explicitly identified.
  • Verification of an insurance document does not guarantee that a particular incident or cost-sharing ride is covered.
  • Hosts must confirm coverage directly with their insurer. Guests should understand the available coverage before participating.
  • Nothing in these Terms claims that private insurance automatically covers every ShareMiles ride.
  • These Terms do not attempt to waive liability for ShareMiles’ own fraud, wilful misconduct, gross negligence, a data breach caused by ShareMiles, or any statutory responsibility that cannot legally be excluded.

ShareMiles’ role

  • ShareMiles provides the technology marketplace and supporting account features.
  • ShareMiles is not a party to the driving or operation of the vehicle except to the extent applicable law determines otherwise.
  • ShareMiles does not control the Host’s vehicle or conduct.
  • ShareMiles does not guarantee member statements, ride availability, arrival, compatibility or conduct.
  • ShareMiles may provide identity or document-verification indicators but does not guarantee authenticity beyond the verification actually performed.
  • ShareMiles may investigate reports and suspend accounts but does not guarantee prevention of every incident.
  • ShareMiles remains responsible for obligations imposed directly upon it by applicable law and does not exclude liability that cannot legally be excluded.

Limitation of liability

  • To the maximum extent permitted by applicable Indian law, ShareMiles excludes liability for indirect, incidental and consequential losses arising from member-to-member rides, except where such exclusion is not permitted.
  • Nothing in these Terms excludes non-waivable consumer rights, or liability for fraud, wilful misconduct, gross negligence, or other liability that cannot legally be excluded.
  • Member-to-member disputes about a Ride are primarily between the Host and Guest. Claims caused directly by ShareMiles’ own wrongful conduct are separate.
  • These Terms do not use an arbitrary liability cap. Any monetary limitation, if introduced, will require separate legal review and clear disclosure.
  • These Terms do not state that members have no legal remedies.

Indemnity

  • A member may be responsible for third-party claims arising from their unlawful conduct, breach of these Terms, misrepresentation, commercial misuse of ShareMiles, unsafe operation of a vehicle, or violation of another person’s rights, to the extent permitted by law.
  • Members are not required to indemnify ShareMiles for ShareMiles’ own negligence, fraud, statutory violation or wrongful conduct.

Cancellations and disputes

  • Hosts and Guests should cancel promptly in-app when plans change and provide a clear reason.
  • While ShareMiles remains free and collects no Ride Contribution through the Platform, ShareMiles does not impose a monetary cancellation penalty unless separately approved, disclosed and implemented.
  • When payment functionality exists, handling of Ride Contributions and refunds will be described in updated Terms and payment disclosures.
  • Members may report disputes and safety concerns in-app. ShareMiles may review evidence and restrict accounts.
  • ShareMiles does not guarantee that it will adjudicate every private dispute between members.

Privacy and location

  • These Terms work together with the Privacy Policy.
  • Using ShareMiles involves processing of identity information, vehicle documents, driving-licence information, ride history, pickup and drop-off details, communications, and safety or incident reports as described in the Privacy Policy.
  • Live-location sharing requires separate, purpose-specific consent limited to an active ride. Optional location consent is not buried inside general Terms acceptance.

Account suspension

  • ShareMiles may restrict, suspend or terminate accounts for suspected commercial activity, unsafe conduct, fraud, harassment, misrepresentation or other policy violations, subject to applicable law.

Changes to these Terms

  • ShareMiles may update these Terms and the Privacy Policy. Material changes will be versioned, archived and communicated in advance where required.
  • Where legally required, members must renew explicit acceptance before publishing a ride or requesting a seat after a material change.
  • Members can review which document version they accepted through consent records maintained by ShareMiles.

Governing law and dispute resolution

  • These Terms are governed by the laws of India.
  • Subject to applicable consumer-protection rules, courts at Hyderabad, Telangana have jurisdiction for disputes arising from these Terms, without prejudice to mandatory rights that apply elsewhere.
